O.G. 456/29.06 - Law no. 130/2011 of 23/06/2011 for the ratification of the Agreement between Romania and the Republic of Moldova in the field of social security, signed at Bucharest on April 27th 2010

According to the Agreement, the person employed on the territory of a contracting party, who is detached by his/her employer on the territory of the other contracting party in order to perform a certain activity, will be subject further on to the legislation of the first contracting party on the duration of performance of this activity, on condition that the predictable duration of this activity does not exceed 24 months.

The independent worker performing the activity usually on the territory of a contracting party and performing an activity on the territory of the other contracting party remains subject to the legislation of the first contracting party, on condition that the predictable duration of this activity does not exceed 24 months.  

If the duration of the activity is extended by more than 24 months, at the common request of the employee and of the employer or independent worker, the legislation of the first contracting party continues to be applied for a period of not more than 24 months, with the agreement of the competent authorities of the two contracting parties. This agreement has to be requested before the expiry of the initial period of 24 months.
