Official Journal 141/February 24th – Order no. 130/2011 as of February 18th, 2011 for amending and supplementing the Norms for applying the provisions of the Governmental Emergency Ordinance no. 158/2005 regarding the leaves and the health insurance fund allowances, approved via the Order of the Minister of Health and of the President of the National Health Insurance Fund no. 60/32/2006

The persons who are employers should submit to the health insurance funds in whose jurisdiction their registered office is located, respectively their residence, the copy no. 2 of the sick leave certificate accompanied by a schedule whose template is provided in appendix no. 18 to the order, only when the reimbursement of the amounts representing the allowances paid to the insured exceeding the amount of the contributions paid to the budget of the unique national health insurance fund is requested. Copy no. 2 of the sick leave certificates is also submitted if the respective allowances are entirely covered by the employer as well as if the insured party does not fulfil the conditions provided by law in order to benefit from such allowances.

At the same time, the phrase “the number of the insured persons within the month” has been redefined, this referring to the number of persons with income who are part of the gross salary fund on the basis of which the contribution for leaves and allowances was applied, that is including the allowances paid to directors and the allowances paid on the basis of management contracts.
