Official Gazette 820/08.12 - Order no. 2730/2010 issued on 30/11/2010 on the organization of the administration of large taxpayers

Starting from January 1st  2011, the quality of large taxpayers is granted to the first 3,000 Romanian legal entities, including the entities resulting from the division or merger with other taxpayers and exclusively the public institutions, selected according to the selection criteria established by this Order. The large taxpayers that do not meet the selection criteria established by this Order will no longer be administered by the General Directorate Administration of Large Taxpayers after two consecutive years in which they do not meet the selection criteria.

The list of large taxpayers will be updated annually, by the order of the President of NAFA, as it shall be drafted, approved and published in the Official Gazette by October 31 each year.

There shall be used the following selection criteria for large taxpayers: the due, declared amount of tax obligations, the income from operations, the amount of staff costs and the tangible and intangible fixed assets volume, but also other specific criteria related to the activity pursued: NBR, banking company, insurance company, NBFI, financial investment company.

Notwithstanding the above provisions, the newly founded taxpayers that, on the date of their foundation, engage by solemn declaration to invest the equivalent of at least 10 million euros can register as large taxpayers. In this respect, the taxpayers will make a solemn declaration at the fiscal body where they declared to be resident for tax purposes, within 5 days from the date of their registration with the Trade Registry.

This Order also approves the list of large taxpayers that will be administered by the general directorates of the administration of large taxpayers started from January 1st  2011.
