Official Gazette 728/02.11 – Decision no. 1037/2010 dated October 13th 2010 regarding the electronic and electric waste

  In this sense, by electronic and electric equipments producer (EEE) can be understood any person, no matter of the used sale technique,that produces and sales electric and electronic equipments under its own brand, resales under its own brand equipments made by other producers or imports or exports EEE, with know how, in or out of Romania or any other member state of EU.

According to the current decision the EEE producers must guarantee collection financing, maintain, value and evacuation of not polluting EEE waste generated by one of the following method:

The failure to fulfill this obligation by the producers may be sanctioned by fine from Lei 40.000 to Lei 50.000, and in some cases by suspending the activity of the economic agent until the the situation is solved.

The costs of collecting, maintaining and non pollution evacuation of the waste shall not be made clear separately when selling new products (it is about green tax). Still, until February 13th of 2011 and for some categories of equipments until February 13th of 2013, the producers can chose for cost presentation, but the amounts herein after presented should not surpass the real costs generated by collection, maintaining and nonpolluting evacuation.

 !!! Attention, the economic operators and public or private institutions which trade in or buy, receive by donation or by other means with a view to sale or internal usage electric and electronic equipments, must require to the producers the registration number from the EEE Producers and Importers  Register .

Not requiring this information is being sanctioned with fine from Lei 20.000 to Lei 40.000, and the entitled Department to apply this sanction is National Authority for Consumer Protection.

Moreover, this current decision foresees also risen fines if not complying with provisions such as::
