This order establishes the method of recovery of trial expenses incurred in judicial proceedings initiated against who hold or held positions of public dignity, high civil servants, civil servants and contractual staff in the Ministry of Public Finances public, NAFA and its subordinated units.
According to GEO no. 46/2009, the persons who hold or held positions of public dignity, high civil servants, civil servants and contractual staff in the Ministry of Public Finances public and NAFA are not responsible from civil or criminal point of view, as appropriate, for the entire period they are in service, unless the courts find out performance or failure of performance by them with guilt, consisting of serious misconduct or gross negligence, of any act or fact related to their exercise, under the law, of their duties.
The trial expenses incurred in judicial proceedings initiated against these persons will be borne by the loans officer, according to the procedure established by the present Order.
