Annual reports on packages and waste packages management

Economic operators introducing on the domestic market packed goods (producers/importers of packed goods), and those who wrap packed goods, economic operators introducing on the market sell-out packages (producers/importers of packages with a view to trade or to pack their own goods), as well as economic operators who take-over waste packages to recover them, respectively to recycle them, are required to submit on an annual basis to the Ministry of Environment and Water management data regarding the packages and waste packages management the latest on February 25^th.

Valuation, respectively recycling of waste packages, can be realized individually or by transfer of liability to a Romanian legal entity authorized to act accordingly by the Ministry of Environment and Water Management.

In the situation of transfer of liability, the authorized Romanian legal entity is required to report the related information to the Ministry of Environment and Water Management, the economic operators being liable to submit on an annual basis the latest on January 15^th, to the same authority, the identification data of the authorized economic operator with whom was concluded the liability transfer agreement.

Economic operators, be they producers or importers of packages (inclusive those who import/export sell-out packages ) are required to report the following data:

• data on the quantities of packages introduced on the domestic market, according to annex no.1 - information on the packaging material and the quantity of packages introduced on the domestic market;
• data on the quantities of packages used to wrap packages that are traded or distributed fee of charge, according to annex no. 2 or, as the case may be, to annex no. 3 - information on the packing material, on the quantity of packages corresponding to the packed goods introduced on the domestic market, their own waste packages which are directly recovered and the way to recover them;
• the quantities of packages used for wrapping the packages estimated to be introduced on the domestic market during the reporting year, according to annex no. 7 - estimated values on the material and quantities of packages corresponding to packed goods introduced on the domestic market.

Economic operators, be they producers or importers of packed goods are required to report the following data:

• data on the quantities of packages used to wrap goods to be traded or distributed free of charge on the domestic market, according to annex no.2 - information on the packing material, the quantity of packages corresponding to packed goods introduced on the domestic market; their own waste packages which are directly recovered and the way to recover them;
• the quantities of packings estimated to be introduced on the domestic market in the reporting year, according to annex no. 7 - estimated values on the packing material and quantities of packages corresponding to packed goods introduced on the domestic market.
• the program used to inform the consumers about the systems of recovery of waste packages.

Economic operators , be they producers/importers of packed goods, introducing on the domestic market during the year a quantity of packages which is smaller or equals 1000 kg, are required to submit to the local authority for environmental protection where their social headquarter is registered only the entire quantity of packages introduced on the market, according to annex no. 3 - information on the material of packings, the quantity of packages corresponding to packed goods introduced on the domestic market, their own waste packages which are directly recovered and the way to recover them.

(The total amount of the quantities of packages introduced on the market in 2006 have been stated on a monthly basis by means of the Environmental Fund Statement).

The annual statements on waste packages must be submitted to the National Agency for Environmental Protection in Bucharest, No. 1 Aleea Lacul Morii, 6^th district.
